The Mohegan Tribal Court was established by the Mohegan Tribal Council pursuant to the Law and Order Code (Section 1-1 of the Mohegan Tribe Code). The Tribal Court has jurisdiction over all civil causes of action under the Law and Order Code and over all lands within the exterior boundaries of the Mohegan Indian Reservation, all trust lands of the Tribe and all lands over which the Tribe has regulatory authority. At the present time, the Tribal Court does not exercise jurisdiction over criminal matters.
The Mohegan Tribal Court consist of three levels: the Trial Court, the Court of Appeals and the Council of Elders Review. There is one Judge and one Chief Clerk of the Court/Administrator.
Any person appearing in Mohegan Tribal Court shall have the right to a spokesman, at his own expense, to assist in presenting the case, provided that such spokesman has been admitted to the Mohegan Tribal Court Bar. A spokesman need not be an attorney.
